Welcome to Boerne Gazette, a publication of Plenara Media LLC (“we,” “us”). These terms govern your use of boernegazette.com and your subscription, if you have one. By using the site, you agree to these terms. If you don’t agree, please don’t use the site.
1. The service
Boerne Gazette publishes local news and information. Some articles are free to read; full access requires a paid subscription.
Free access. Visitors may read a limited number of articles at no charge in each rolling period. The current free-article allowance is shown on our subscribe page and may change. We track this with a cookie as described in our Privacy Policy.
2. Accounts and sign-in
You can sign in using an emailed sign-in link or with a Google account. You’re responsible for the accuracy of the email address you provide and for keeping access to your email or Google account secure — anyone with access to them can access your Boerne Gazette account. Accounts are specific to Boerne Gazette and this site.
3. Subscriptions and billing
Subscriptions are billed by Stripe, our payment processor.
Automatic renewal. Subscriptions are recurring. A monthly subscription renews and is charged automatically each month, and an annual subscription renews and is charged automatically each year, in each case at the price disclosed to you at checkout, until you cancel.
How to cancel. You can cancel at any time online through the subscription management page linked from your account (no phone call or email required). Cancellation takes effect at the end of your current billing period, and you keep access until then.
Price changes. If we change subscription prices, we’ll notify you by email at least 30 days before the new price applies to your subscription, and you may cancel before it takes effect.
4. Refunds
Because you can cancel at any time and keep access through the end of the period you’ve paid for, we generally do not provide refunds or credits for partial billing periods, except where required by law. If you believe you’ve been charged in error, contact us at [email protected] and we’ll make it right.
5. Acceptable use
You agree not to: circumvent or attempt to circumvent the article meter or paywall; share subscriber access at scale or resell access; scrape, crawl, or systematically copy the site’s content, including for training machine-learning models, without our written permission; interfere with the operation or security of the site; or use the site for any unlawful purpose.
6. Content and your license to use it
The content on Boerne Gazette is owned by or licensed to Plenara Media LLC and protected by copyright and other laws. We grant you a personal, non-commercial license to read and use the site. You may quote brief excerpts with attribution and a link to the original article. Republishing full articles or substantial portions requires our written permission ([email protected]).
7. Corrections and retractions
We aim for accuracy and correct errors when we find them. Corrected or retracted articles are updated or replaced with a notice, and retracted articles are listed on our retractions page. If you believe something we’ve published is inaccurate, contact us at [email protected].
8. Disclaimers
The site and its content are provided “as is.” While we work to be accurate, we don’t warrant that content is complete, current, or error-free. Content is provided for general informational purposes and is not legal, financial, medical, or other professional advice.
9. Limitation of liability
To the fullest extent permitted by law, Plenara Media LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site, and our total liability for any claim relating to the site or your subscription will not exceed the amount you paid us in the twelve months before the claim arose. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.
10. Termination
You can stop using the site or cancel your subscription at any time. We may suspend or terminate access for violation of these terms; if we terminate a paid subscription without cause, we’ll refund the unused portion of your billing period.
11. Governing law and venue
These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute arising from these terms or your use of the site that we can’t resolve informally must be brought exclusively in the state or federal courts located in Wyoming, and both parties consent to their jurisdiction — except that either party may bring an eligible individual claim in small-claims court.
12. Changes to these terms
We may update these terms from time to time. If we make material changes, we’ll update the effective date above and notify subscribers by email or a notice on the site before the changes take effect. Continued use of the site after changes take effect constitutes acceptance.
